James P. Kelly is a founding partner of Franks & Kelly, P.C., Attorneys at Law and represents individuals, businesses, municipalities, and local governmental entities throughout McHenry County and the surrounding areas. Licensed to practice law in Illinois, Mr. Kelly is also admitted to practice before the United States District Court for the Northern District of Illinois Trial Bar and the United States Court of Appeals for the Seventh Circuit.

Before attending law school, Mr. Kelly served as an officer in the United States Army for 12 years. His military background helped shape the discipline, preparation, and practical problem-solving approach he brings to his legal practice today.

Prior to entering private practice, Mr. Kelly served for more than eight years as a Senior Litigation Attorney in the Civil Division of the McHenry County State’s Attorney’s Office. In that role, he represented numerous county departments and governmental bodies, including the McHenry County Board, Sheriff’s Office, Recorder of Deeds, Clerk’s Office, Planning and Development Department, and Transportation Department.

During his time with McHenry County, Mr. Kelly advised county officials and local governmental entities on a broad range of legal matters involving land use and zoning issues, complex contract negotiation, government financing, personnel policies, FOIA and Open Meetings Act compliance, community development matters, and municipal procedures. He also represented the County in both state and federal litigation involving land use disputes, civil rights claims, contract matters, and other complex legal issues.

Drawing on both his government and private practice experience, Mr. Kelly represents clients across a broad range of legal matters, including civil litigation, contract disputes, real estate matters, zoning and land use issues, municipal and township law, bankruptcy matters, probate disputes, corporate matters, and estate planning concerns.

Mr. Kelly has substantial experience representing municipalities, townships, businesses, and individuals in litigation involving property disputes, land use matters, employment-related claims, breach of contract allegations, personal injury claims, and administrative proceedings before various state and local agencies. He has also advised businesses and local governments on matters involving contracts, development projects, employee policies, financing issues, and regulatory compliance.

In private practice, Mr. Kelly has also represented individuals and families in matters involving divorce, guardianship proceedings, probate administration, juvenile court matters, and related legal concerns throughout McHenry County.

Mr. Kelly is known for providing practical legal guidance, thorough case preparation, and strategic representation tailored to the unique circumstances involved in each matter. His broad legal background allows him to assist clients facing both complex litigation matters and day-to-day legal issues affecting their businesses, property interests, and personal lives.
